Terms of Sale

Welcome to Peter McBride Art (“Artist,” “we,” “us,” or “our”). These Terms of Sale apply to purchases made through www.petermcbrideart.com (the “Website”).
By placing an order through the Website, you (“Buyer,” “you,” or “your”) agree to these Terms of Sale. Please read them carefully before completing your purchase.
1. Artwork and Product Information
We make every effort to present artwork accurately, including its colors, dimensions, materials, framing, and other characteristics. Because artwork is photographed and viewed on different screens and devices, colors may appear slightly different from the actual artwork.
Each artwork listing will identify whether the item is an original artwork, limited-edition print, open-edition print, reproduction, digital product, commission, or other product.
Unless expressly stated otherwise, artwork is sold unframed.
2. Original Artwork
Original artwork is a unique physical work created by the Artist. Unless otherwise noted in the product description, the sale of an original artwork includes the physical artwork only.
Purchase of an original artwork does not transfer copyright, reproduction rights, trademark rights, or other intellectual-property rights to the Buyer.
The Artist retains all rights to photograph, reproduce, publish, display, promote, and otherwise use images of sold artwork.
3. Prints and Limited Editions
Prints and reproductions are produced according to the specifications described in the individual product listing.
For limited-edition artwork, the edition size and numbering will be identified in the product description. Once a limited edition is sold out, the Artist will not produce additional numbered copies of that edition unless expressly stated otherwise.
Minor variations in color, paper, texture, or printing may occur between individual prints and the images shown on the Website.
4. Commissions and Custom Artwork
Commissioned or personalized artwork is created specifically for the Buyer and may require a separate agreement describing the scope, price, schedule, materials, and other requirements.
A commission is not considered accepted until the Artist has confirmed the project and received any required deposit.
Unless otherwise agreed in writing:
A deposit is non-refundable once work has begun.
The Artist will make reasonable efforts to meet agreed deadlines but cannot guarantee completion dates affected by circumstances outside the Artist's control.
The Buyer is responsible for providing accurate reference materials and specifications.
Significant changes requested after work has begun may result in additional charges.
The final artwork may contain reasonable artistic variations from preliminary sketches, reference photographs, or discussions.
5. Pricing
All prices are displayed in U.S. dollars unless otherwise stated.
Prices may change at any time; however, the price displayed when an order is successfully placed will apply to that order.
Applicable sales tax, shipping charges, and other fees will be added at checkout when required.
The Artist reserves the right to correct typographical, pricing, inventory, or technical errors on the Website. If an order was placed based on an obvious error, the Artist may cancel the order and issue a full refund.
6. Payment
Payment must be successfully processed before an order is considered confirmed.
We may use third-party payment processors to process transactions. Payment information is handled according to the applicable payment processor's terms and privacy practices.
The Artist does not retain complete credit-card information.
7. Shipping
Artwork will be shipped to the address provided by the Buyer at checkout.
Shipping costs and estimated delivery times will be displayed during checkout or in the applicable product listing.
Delivery dates are estimates and are not guaranteed. The Artist is not responsible for delays caused by shipping carriers, weather, natural disasters, customs, strikes, or other circumstances beyond our reasonable control.
International Buyers are responsible for any applicable customs duties, import taxes, brokerage fees, or other charges imposed by the destination country.
8. Damage During Shipping
The Artist takes reasonable care to package artwork appropriately for shipment.
If artwork arrives damaged, please contact us at petermcbrideart@gmail.comwithin 48 hours of delivery. Please retain the artwork, shipping box, packaging materials, and other shipping documentation and provide photographs when requested.
We will work with you and, where appropriate, the shipping carrier to resolve the issue.
9. Returns and Exchanges
We want you to be happy with your purchase.
Unless otherwise stated in the product listing, eligible artwork may be returned within 14 days of delivery for a refund, subject to the following conditions:
The artwork must be returned in its original condition.
The artwork must be securely packaged.
The Buyer is responsible for return shipping costs unless the artwork was damaged upon arrival, defective, or incorrectly shipped.
The original shipping charge is generally non-refundable.
Refunds will be issued after the returned artwork has been received and inspected.
Custom, commissioned, personalized, or made-to-order artwork is not eligible for return or refund, except where required by applicable law or where the artwork arrives damaged or materially differs from the agreed specifications.
Please contact petermcbrideart@gmail.com before returning any artwork. Unauthorized returns may not be accepted.
10. Cancellations
Orders may be cancelled before the artwork has shipped by contacting petermcbrideart@gmail.com.
Because commissioned, personalized, and made-to-order artwork is created specifically for the Buyer, cancellation terms for those purchases may differ and will be governed by the applicable commission agreement.
Once an order has shipped, it may be subject to the return provisions described above.
11. Copyright and Intellectual Property
All artwork displayed on the Website, including paintings, drawings, photographs, illustrations, designs, graphics, written content, logos, and other creative materials, is protected by applicable copyright and other intellectual-property laws.
Purchasing artwork does NOT grant the Buyer permission to:
Reproduce or scan the artwork;
Create prints or other reproductions;
Use the artwork commercially;
Sell or license reproductions;
Use the artwork in advertising or merchandise;
Digitally alter and distribute the artwork; or
Claim the artwork as their own.
Any commercial or other reproduction rights must be separately authorized in writing by the Artist.
12. Personal Display and Social Media
Buyers are welcome to display purchased artwork in their homes, offices, or other lawful personal spaces.
Buyers may also photograph their purchased artwork for personal use or social-media posts, provided that such use does not imply that the Buyer created the artwork or owns the Artist's copyright.
When reasonably practical, we appreciate attribution to Peter McBride when artwork is shared online.
13. Artist's Right to Photograph and Display Sold Work
The Artist retains the right to photograph and display images of artwork before or after its sale for purposes including portfolios, exhibitions, social media, websites, publications, advertising, and promotion of the Artist's work.
Unless separately agreed in writing, purchasing an artwork does not give the Buyer the right to prevent such use.
14. Artwork Care
The Buyer is responsible for appropriate care, handling, installation, storage, and display of purchased artwork.
Artwork should be protected from excessive moisture, direct sunlight, extreme temperatures, and other conditions that may damage the artwork.
The Artist is not responsible for damage resulting from improper handling, installation, storage, environmental conditions, accidents, or ordinary wear and tear after delivery.
15. Website Availability
We make reasonable efforts to keep the Website accurate and available, but we do not guarantee that the Website will always be uninterrupted, error-free, or free of technical problems.
Product availability may change without notice.
16. Limitation of Liability
To the fullest extent permitted by applicable law, the Artist's total liability arising from the purchase of artwork will not exceed the amount actually paid by the Buyer for the artwork giving rise to the claim.
Nothing in these Terms limits any rights or remedies that cannot legally be excluded or limited under applicable law.

These Terms of Sale are governed by the laws of the State of California, without regard to its conflict-of-law principles.
Any dispute arising from these Terms or a purchase through the Website will be subject to the applicable laws and courts of Sacramento County, California, except where applicable law requires otherwise.
19. Changes to These Terms
We may update these Terms of Sale from time to time. The version of the Terms in effect when an order is placed will generally govern that purchase.
The current version will always be posted on the Website.
